Patreon Giveaway Policy Is Changing

I've received a message from Patreon saying that my policy of giving away items at random to $5 and up patrons is in violation of TOS. Before you get out your pitchforks, please read to the end. I need your feedback on how to handle this, but I want you to understand why this is being done first.

There are state and federal laws pertaining to games of chance (gambling). These laws are important because they protect people from being taken advantage of. For example: you have no idea whether I am actually selecting my giveaway winners randomly. I could be giving products only to my friends, or I could be making up these names entirely and not giving products away at all.

In this case, you trust me, and you don't mind the situation. But the laws exist to protect people from abusive situations, and they apply to my giveaways. Actually, they apply to almost every giveaway that you see on the Internet, and the majority of those giveaways are not actually legal--but nobody cares.

In order to be more compliant with the law, Patreon is enforcing their policy against doing random giveaways as part of reward tiers. In fact, it's not even allowed to give things away only to Patrons. It costs money to become a Patron, and the characteristic that invokes the law is that you are paying for access to a game of chance (randomized giveaway).

In order for me to do giveaways, they would have to be accessible to anyone, patron or no.

Or I could do a product giveaway where everyone at a given tier gets the same item, and there is no randomness. But this is tricky because I'm not sure what kind of reward I could come up with that hundreds of people could get for just $5 a month.

Until I can figure out some way to reward people without violating Patreon's TOS, I am stopping giveaways.  If this change matters to you, then you can edit your pledge to a lower level using the link below. I still would very much like to be able to do giveaways to Patrons, but I can't violate Patreon's TOS or the law to do it.

I have always said that I hope you are subscribing based on the value you get from my content, NOT because you are hoping for a giveaway item.  I hope that most of you will continue to pledge at the same level. Please comment below with your thoughts on this issue.

No worries here. I have plenty of stuff in my cave already, besides my wife wouldnt believe me if I told her this was free and I won a give away!! That trick worked for the first few boxes!! Lol. I donate $2 a month because I'm a cheap bastard. I spend that on coffee 2 times a day. But honestly, I was coming in to pull my $2 a month because I don't quad year round and my interests are changing. Also I'm broke because I eat out every day and too lazy to pack a lunch. But of course i would be happy to get one Day somthing! I am now 2 Years very sick becouse i not able to move my legs anymore after a normal knee operation and 3 weeks ago my Women where taking my Sohn 3.5 Years old and took all my Money and empty my komplett Haus. So i dont have anything any more, game over ! Till i start to work again i just have a little Money i am not even able to buy me a new Kitchen Tabel or Disches or a new cheer. Yeah, I’m a Patreon, because you taught me to fly drones, and 2/3 of what I know about the hobby, all via YouTube. I decided clicking links and streaming your channel all week still wasn’t giving YOU enough. 👍🎯

The giveaways are nice for sure. But the reason I’m a Patreon is to support the man who supports the hobby. Josh, has helped and brought so many to the hobby. Thank you, Josh. Giveaways are not needed be welcomed.

I've recently had to withdrawal my pleadge due to personal bs but as soon as I'm stable you have my full support again and NOT FOR giveaways of products. How can they quantify the the amount of knowledge you share freely everyday.. on behalf of the whole fpv community if I may, ty for all you do for N00bs and ogs everywhere... This community needs you and you serve such an essential role, please dont let anything lead you away from that... we, who cant afford to buy every product need a reliable source of info you have been that for years even helping EACH one of us PERSONALLY... who does that?? Thank you and I will be a patron again asap!

Still 100% support you. I didn’t join for random give aways. You need to protect yourself and comply with the law. I’ve heard about this particular problem in Canada, we have quite strict legislation around gambling.

The freebies are fun however I'm a patreon because I learn a lot from you and want to do my small part to help ensure you can afford to continue publishing hopefully full-time knowledge / learning based videos.

You can choose the winner by random and then sell that item to them for $1. I have multiple friends that do that

Joshua on a side note if you wanted to, you could change the label. Pick one person per month for product testing. Upon completion of product testing the tester keeps the product. This is not a giveaway because it requires something in return. The product tester would have to give a product review back to you from there it would be up to you to decide to publish their review. To be a product tester you would have to be a tier whatever to participate.

I am a $5 Patron because of what you offer. Perhaps your giveaways can be announced on Youtube and include all Patrons automatically? Maybe automatic multiple entries for $5+ patrons? Too complicated or illegal?

Definitely not doing it for the wins. You give SO much to the community. I’ll be a subscriber as long as you continue to give content away (which is the most valuable giveaway!).

I’m a patron simply because I learned many things from your videos. So for me is like I’m slowing playing you a coffee for your lessons. :-) As for the giveaways, I honestly don’t care. But the simple solution for this is just open it up to all tiers. If you want to give more perks to the highers tiers, just get them some coupons for the RR store or make some custom “You’re going to learn something today” by JB shirts

No change here in my support. Always learn something from your videos. I would say to you and all the other drone based Ytubers who do givaways perhaps if you could get those good products to newbies or pilots who might not have the funds to buy a certain product. Why should someone who already has 10 quads win one for free.

If you really want to do giveaways for 5 dollar patrons, it looks like the discord might need a private room? ahem ahem either way, my contribution remains the same. I didn't sign up for the freebies.

I have also pledged based on information and encouragement you continue to provide. If I were to sign something that says I do not expect further compensation in the form of prizes or giveaways, would this satisfy the legal obligations and allow you to do random drawings as you have been doing? And I do trust you chose randomly, as I do others I support through Patreon.

As a recent freebie recipient I'm currently sharpening my pitchfork. In all reality though while you have to allow everyone to participate, what are the rules on telling people? You could, while still following the laws (it seems) only INFORM your $5 patreons or $1 patreons or whatever of a giveaway and just leave the ability to participate open. Sure 5 dollar guys will let one dollar guys or no dollar guys know but it might be worth a try.

I never signed up for freebies, I'm not doing it for any material reward. I figured I learned so much from you, I have saved so much time. I hope you can do this as your full time job, anyone who can escape the 9-5 bs and do something they enjoy I'm glad to support that with my little contribution.

Don't post any more give aways. I'm not a patreon for free stuff. You provide an immense amount of information to my hobby and you beat having to read magazine ads. Plus, there's no law for sending thank-you gifts.

I'll stay at the same level, but I'm also happy for you to maximise your opportunities to attract more patrons. It's a tough game or there for people like yourself to get started. If there existed a legal lottery service, would that appease the patron TOS? IE. If it were a legit lotto service that has proven randomness?

Regardless of any giveaways, I’m here to support your efforts in building the hobby. However, it would be lie to say that I don’t like the chance to win something. That being said, maybe just limit the giveaways to the Youtube general public. Perhaps, you could combine the two, so that Patreon supporters get extra chances, over the general public. Many contests are free to enter once but require more to get more chances to win. Just throwing that out there...lol

As long as I am flying quads and you are releasing educational vids on quad flying, you will have my support... Besides, I already won some goggles, So I can't complain. Thanks so much for being such an amazing positive influence on the hobby. I know that it would not be advancing as fast or have as many people enjoying it without you and your willingness to share your knowledge.

I value the fact that your doing this full time and I’m helping (albeit a small amount) you do this. The content is the reward, there is more of it and it’s higher quality because your full time. JB, the information you provide has been incredibly valuable to me. I'm positive you have saved me far more than what I have provided to you through Patreon. You did not have to offer giveaways to get support. The fact that you offered giveaways I believe speaks to the integrity of the information you provide. Giveaway or not, I will continue to support you through Patreon. I would not even worry about trying to figure out something else, just stop the giveaways.

Giveaways are nice but the information you provide helps me out way more than any give away! I definitely know a lot more about quads ,tuning,flying etc etc from you’re videos so I really appreciate what you do and maybe you can giveaways at later time or some cool shirt with you’re logo but my contribution will stay same as you have helped me through videos and advice much appreciated!!

Looks like most of us have the same idea about the reasons we subscribed. I stopped posting comments on YouTube or here on giveaways a while ago because I had a wrong feeling expecting to be the lucky winner instead of following your videos.

You could post a small YouTube video regarding the giveaway and have patreons post their patreon handle in the comment, then ensure that the commenter that won does have a $5 plus subscription

As a patron who has won something, I am here for your help and knowledge. Winning free stuff was nice, but it certainly was not why I am a patron. I am a patron because it is a way for me to reciprocate for the time and help you have given me. Other youtube fpv stars tell lots of jokes and tell me which new quad to buy this week, but never even bother to respond to my posts on their channel, let alone actually help me. On the other hand you have taken the time to help me through 2 major problems. Each time you help me I increase my level of support. I also bought JB fc and JBcharge board. Again, both to support you for helping me, and because they are great products. In conclusion, the give aways are fun but they have no bearing on why I am a patron.

Like everyone else, I joined for the content and to support your continued work. Though I will say I really appreciated how the chance at a give away did make me feel special and I looked forward to the results to see if I got lucky. Since the give aways are win-win in that you can ship things you don't need to those who do need/want them. You could still select a "friend" perhaps by random and ask if they wanted something and then ship it to them. Since this action is just a friend giving something to a friend and is unannounced . . . I don't see the legal issue. Unfortunately you wouldn't get the advantage of advertising you were doing something nice for your supporters though.

Good to know, but like most doesn't change anything for me. Although as a side note (not sure if you could do this anyway as I guess it still has a theoretical value in your time) but I always thought it would be really cool to win the chance to have a quad tuned by you. On the premise that the winner accepts all shipping costs back and forth and accepts the possibility that something may get damaged if you crash and doesn't hold you responsible for it. Whether that's Patron or everyone it might be fun. Plus Ive been flying long enough to tune a quad now but when you start unless you know anyone experienced, you don't actually know what a well tuned quad feels like. Or they win a chance for you to build a quad for them and send you all the components. I appreciate there's challenges and pitfalls in doing this but I think it would get a lot of interest. Either way keep up the good work.

Hello JB. I have only occasionally entered your giveaways. Even so, it was very nice to know that I, as a patron, had access to something your regular youtube viewers (the non-patron variety) didn't. It sucks that the giveaways have to stop (at least for now). With time I'm sure you and other people who get support through Patreon will figure something out that will allow the patrons to feel a bit special and appreciated by the folks we support. Maybe you could auction the stuff you'd otherwise be giving away to a random patron? Keeping the auction open only to patrons. Would that be legal? I have no intention of altering my pledge; please keep up the great work that you are doing.

First off, I, like most of your patrons, subscribe fully because I want to support your work. That being said, I do like the idea of a random giveaway from time to time. I have seen other creators offer a random $1 or $2 sale, where the winner gets to buy an item for an arbitrary cheap amount. That makes it a transaction and allows any potential "winner" to opt out if they don't want that prize.

Don’t stress about it. I know it is your bread and butter and therefore hard not to. However, I think you should not bother with the give away thing.

Not a very good investment if your only here on the chance of winning a giveaway in my opinion. The investment for me is your real time support when I have issues and the content you provide almost daily. With that said, couldn't you just move give-always to discord or during live-stream events? With how linked these applications are though I am not sure how that could be done legally. At any rate, no big deal.

Are donations the same as giveaways under the tos... I say this because this was how we got around raising money for a charity one time... we were not allowed to sell tickets to win a prize ... but people were allowed to donate. I wonder if you could donate items to pilots in need! .... Cheeky "twist" I know ... but it worked for us (but that was in the UK)

I am here to support you for all the awesome things you do. The giveaways are the last thing i care about here. I just want to make sure you can keep going buy giving a little each month.

Well it sucks that giveaways are ending, but part of what I like about them isn't that I might get something. I think it's more I'm interested in seeing the random sorts of things that show up. My favorite was the "skinned" quadcopter - that was fun to see! I don't even care who got it. But, yeah, I'm not at this level for the giveaways. Hopefully you'll keep them, and just move them to youtube. I think it would be a little exciting to receive something physical, just because I like opening the mail. Stickers or postcards or JBARDWELL battery straps every so often, but I know that the mailing process is tedious and the expense can quickly eclipse the money you're getting from the support level. I don't want that to happen, I'd rather you spend your time doing QUADCOPTER SCIENCE! than slapping postage labels on stuff. So, TL;DR I think I'll stick around =]

I had wondered if this was going to affect us all. I have seen a few other pages that have gotten this notice and have been waiting to get one myself but haven’t yet. This isn’t a new policy from Patreon. Their FAQ from 2016 actually said giveaways were not allowed. They just didn’t enforce it.
