Commercial Use License

As a Legendary or higher tier patron, you can use my cartographic artwork as published, but not the map assets or derived versions of my maps, for commercial publications. I like to keep things simple and straightforward, but there are some limitations and terms you have to accept before using my artwork for commercial purposes.

Short version

You can use my maps for commercial purposes as long as:

• You are an active patron with a Commercial Use Subscription reward.
• You follow the limitations of your subscription tier.
• You credit me for my artwork (e.g. "Cartography by Miska Fredman").
• You don't alter my artwork or do only minor alterations, such as crop the image, add text or labels or hide existing layers from editable files,, etc. Not allowed: recoloring, distorting the proportions, or combining artwork with other graphics or artwork (including my map assets), and other such radical modifications.
• You don't resell my artwork or map assets, use them in competing products, or in stuff that's generally considered offensive or obscene. 
• A minimum of 2000 words must accompany each map used in a publication.
• The yearly sales revenue of your business is less than your licence level’s limit. If this limit is exceeded, please switch to a higher tier or contact me (see contact info below).

You retain the commercial use rights to use my Artwork in your current products if you quit your patronage,  change to a tier without the Commercial Use Subscription reward.

License Levels

Please note that the limits are per month and unused published maps do not carry over to following months. 

Limited

• Can be used in monetized streams and videos, and by professional GMs without the minimum word requirement or publication limit.
• Published maps per month in print or digital products: 1
• Yearly revenue limit from TTRPG related products or services: $10’000 USD.

Commercial Use I

• Can be used in monetized streams and videos, and by professional GMs without the minimum word requirement or publication limit.
• Published maps per month in print or digital products: 2
• Yearly revenue limit from TTRPG related products or services: $25’000 USD.

Commercial Use II

• Can be used in monetized streams and videos, and by professional GMs without the minimum word requirement or publication limit.
• Published maps per month in print or digital products: 4
• Miska’s Maps assets can be used to customize maps and adventures, but you cannot mix these with assets or maps from other creators.
• You can use Miska’s Maps character and vehicle tokens in your adventures if there is a total of at least 3000 words of relevant and original creative gaming content included in the product.
• Yearly revenue limit from TTRPG related products or services: $50’000 USD.

Commercial Use III

• Can be used in monetized streams and videos, and by professional GMs without the minimum word requirement or publication limit.
• Published maps per month in print or digital products: 8
• Miska’s Maps assets can be used to customize maps and adventures, but you cannot mix these with assets or maps from other creators.
• You can use Miska’s Maps character and vehicle tokens in your adventures if there is a total of at least 3000 words of relevant and original creative gaming content included in the product.
• Yearly revenue limit from TTRPG related products or services: $100’000 USD.

Long version

DEFINITIONS

• Licensor means: Miska Fredman, also Miska's Maps 
• Artwork means: Any role-playing game cartography art created, sold, or owned by Miska Fredman (Licensor), and obtained through Patreon while being an active patron of Miska's Maps, These are NOT covered by this license unless explicitly stated otherwise: any other content than map image files, like map props, assets, tokens, sounds, audio files, Foundry VTT  modules, adventures, stories, characters, creatures, items, or decals, AND any maps noted as "Non-commercial".  
• Licensee means: An active patron of Miska's Maps subscribed to a tier with a  Commercial Use Subscription reward 

TERMS OF USE
This agreement grants the Licensee a limited, worldwide, non-transferable, non-assignable, non-exclusive license to use Artwork for the permitted uses described below while being an active patron of Miska's Maps at a tier with a Commercial Use Subscription reward.

• The included Artwork can be used for any number of titles, products, projects, and/or publications for commercial purposes as long as these do not exceed the limits of of your license level. If and when this limit is surpassed, you need to switch to a higher tier or contact Licensor as soon as possible. See for contact information below.
• Licensor retains the right to sell the use of Artwork. Except for your right to use Artwork granted by this license, all other rights, title, and interest in the images and related trademarks and trade names are owned and retained by Licensor.
• The licensed Artwork can be used for printed and digital publications, advertisement and promotional materials, and websites, as long as the Artwork is not the primary element of the publication or web page, with the restrictions detailed below.

ALLOWED ALTERATIONS
You may alter the Artwork in the following ways:

• Reduce a color image to grayscale for the purpose of printing in that color scheme
• Change the color mode from RBG to CMYK.
• Make minor alterations, such as add text or keys on the map, flip the map horizontally or vertically without altering its proportions, edit texts, or hide existing layers from the Artwork.
• Crop the images (see Credit, for details) to make them fit the publication better.

RESTRICTIONS ON USE
You may not alter or use the Artwork in the following ways:

• No major alterations that distort the original Artwork. These include, but are not limited to, coloring or recoloring, altering the proportions of the Artwork, or combining the map with art or graphic elements from other artists or my own map assets. 
• You may not use the Artwork as the basis for any other physical or digital merchandise or promotional items, which you offer for sale, such as but not limited to t-shirts, greeting cards, mugs, posters, prints, and so on.
• A minimum of 2000 words of relevant and original gaming content must accompany each map used in a publication. This could be an adventure, a location description, or similar creative content.
• You cannot resell the Artwork or redistribute it in any way that competes with them.
• You cannot use the Artwork (in whole or in part) as a trademark, service mark, logo, or other indication of origin, or as part thereof, or to otherwise endorse or imply the endorsement of any goods and/or services.
• You are not authorized to sub-license, sell, or lease the Artwork, nor may you temporarily or permanently transfer your rights under this Agreement to a third party. This includes, by way of illustration only and not by way of limitation, displaying Artwork in any format (including thumbnails) for download on a website, offering the Artwork for sale, or including images in templates of any nature, including web templates, document templates, projects, or otherwise for distribution and/or sale to third parties.
• Use the Artwork in a way that can be considered generally offensive, obscene, or immoral, including pornographic, racist, or sexist material. If your project is in some way borderline on this subject, please contact me before using the Artwork. 

CREDIT
If you use any Artwork bound by this Agreement in a publication you must include one of the following in the credits:

• Licensor’s name in the credits as a cartographer or under some other relevant title (e.g. “Cartography by Miska Fredman”)
• Some artwork © Miska Fredman, used with permission. All rights reserved.

If the Artwork is used online or in an editorial manner, a link to www.miskasmaps.com or patreon.com/miskasmaps should be included in the credits or adjacent to the Artwork.
If you crop out the artist’s signature or identifying mark from the Artwork then you must include the following statement next to the image: “© Miska Fredman”, or add a mention in the credits of the pages where Artwork is used.

TERMINATION AND DISCLAIMERS
You acknowledge that you have read, understand, and agree to be bound by the terms and conditions of this agreement and the international copyright law.    

This agreement will immediately and automatically terminate without notice if you fail to comply with any term or condition of this Agreement. 

• If you are no longer an active patron, but your current publications or products using Artwork are published in accordance with the sections "TERMS OF USE" and "ALLOWED ALTERATIONS", you retain the rights to use these products and publication commercially.
• If this Agreement is terminated as a result of breaking any of the limitations mentioned under section "RESTRICTIONS ON USE ", you agree to destroy all images or documents using the Artwork in your possession, including any product or publication within which you have employed the images.
