Some if not all states can still prosecute if under. District attorneys can argue that even though they are not at the legal limit, impairment could still be argued. One person's . 08 is not the same as someone else's. 08 Also they could argue the time between the initial arrest and when she blew her bac dropped. I'm not an expert these are just things that I have seen cases of before.
